My ex works for her fiance under the table. We are going in for a child support hearing to adjust what I pay and I've been told that because she is showing no income I could end up paying a substantial amount more. She quit a job making a bit more than I did to work for this guy. I've never been late on a payment and also cover my son's heathcare costs. My pay has not increased since the last adjustment. Am I screwed or is there something I can do to bring this to the courts attention?

Each parent has a responsibility to provide for their child. If she’s showing zero income, the court will want to know why. Tell them what’s going on.

At the very least you need to request that they base the child support on ‘imputed’ income (the amount of money she should reasonably be able to earn if she chose to work).

Yes, your payment will go up without a doubt. If you really want to save yourself and not worry about the consequences for your ex and the "boss", report him to the employment office. She will be asked why she is with this new employer, and what happened at the last one, how she is supporting herself if she has no income. The judges and support enforcement are not stupid, they know that women very often work under the table, or are partially supported by a boyfriend, if she says she has no income, big red flags waving howdy! If she says she has a little income, she will be required to show proof of income, if she cannot or submits forged documents, you can bring this up to the court. Don't give up, you're not screwed, you have a responsibility to your children to offer financial,emotional support, if she can't show income on a regular basis, custody could be changed if she can't provide a regular, normal stable environment for her children. Good luck, don't let your anger at her affect your relationship with the kids, never talk the other parent down, it just makes the kids feel so insecure, and sad, and wonder how they are loved if they are living with this horrible person, be fair about what really goes on.

you need to protect yourself from being taken advantage of, if she has a child to support why would she take a job making less money? she was only thinking of herself and how nice it would be working with her new fiance, believe me she thought this through, she took the job paying less cause she knew she would just take you back to court and you would end up paying the difference, you have to let the court know what is gong on, all they have to do is audit her expenditures verses her income and they will see she is lying, this happens all the time to men, the divorce laws in this country are so screwed up and one sided! stick it to her, why should you have to pay extra for her to work with her knew man.

Hopefully the court will question her going from a good income to none and I would certainly bring it to their attention. But your child support is based on both saleries so your best bet is to find someway to prove hers or get the court on your side. Try looking up a child support calculator for your state, I am in VA and found one online that may give you a better idea of what you are looking at. Good luck to ya!

You should for sure tell the court. It is already suspicious that she shows no income, so if you have a reasonable explanation for the judge, that is good. Also, if you come across as the reasonable parent who is trying to do right by the children, that will normally take you very far.

Do some discovery, you are entitled to it.

The court goes molstly on your income not hers if she has the child..remember they have a cap on how much one pays. Its good you have not missed any payments and its good your paying health insurance courts see that most likly nothing will change unless your trying to change it Oh yeah let me remind you the more time you get with your child the lower child support is, make that change and when they child reaches 12 they can usually choose who they want to live with can you imagine it being reversed amd her paying..Mmmmm

If she is showing no income, but getting money under the table, than she is committing a crime against the federal and local government. If you can somehow prove that she is working for him, more the better. Take it to court and press the issue.

that is so unfair. i had to fight to get my ex to pay up and he doesnt give me a penny more than awarded no matter what our son might need! on that basis id say you are doing your best and shouldnt allow yourself to get screwed over. my advice would be to try and get a witness (someone with clout) to attend the hearing with some sort of proof about this illegal income. they need to be there in person though as courts wont take written statements (sorry for the essay!!)

That will make you look like a heel, I would not recommend it. Child support is based on YOUR income, it is not welfare, where she has to prove how poor she is. My hubby paid $1200 a month for ONE kid, plus all the other crap, health insurance half of all out of pocket, etc...His ex made 100K per year. I was in the courtroom, and in the many, many trips to the lawyer for all of this, saw all of it firsthand. Just pay it, it IS for your kids, when they are 18, you will be done with it.

i really didnt have income at my child support hearing, and the judge asked my previous jobs and education and estimated an income for me. theyll do the same for you, if they dont, you should ask about it.
