I have been working for a large mobile company in th call centre, My doctor says that i now have holes in my ear drums that will need surgury to fix and i can not work there till its fixed,

My work place have said that there is no other job for me and made me stay on the sick and now that i have ran out of sick money,
My Dr thinks that they may have caused it but can not be sure

What can i do or say to them?

Contact your union for advice. Or if not in a union contact a local solicitor to see if you can make a claim.

Hmmm. Ok. This can be difficult one.

If you believe that your condition is related to work, then you can inform the HSE (Health and Safety Executive) and they will investigate under the Health and Safety at Work Act 1974. It may be worth getting your Doctor to write a note to suggest that your condition may be attributed to your work.
You MAYbe able to claim back damages - loss of earnings - at the end of it all.

Other than that, check you terms and conditions of employment to see what your Company Sick pay terms are (if you have any) and see whether you have exhausted it or not.

Also, when you have had your operation, your employer is obliged to make reasonable adjustments for you at work....that could be buying a special headset for you (I'm not sure what is available out there).

Basically, your condition will be considered one under the Disibility Discrimination Act 1995 and your employer would be negligent...and any employer would be careful of such legislation as they should know that if you had a claim against them and you were successful then they will know that there is no limit to compensation available to you....

I would suggest that you get referred to an ear specialist, and find out if work was what caused your ear problem. If so find out if there's anything you can do(like a type of earplug you can get) to still work there.

Otherwise you'll just have to look for a new job, if you cannot do this one. But if it's a large company see if you can apply with human resources for any upcoming jobs in other areas that do not require using phones as much.

If you're in a union speak to your steward. Unions can get you free legal advice on industrial injury and can tell you if your employer in acting illegally.

Think of your health, your health is more important. please find another job and seek legal advice because you MAY be entitled to compensation for the damage to your ear drums.
