The "tax" they are charging is NOT a state or federal tax. It is a tax that McDonald's is charging and pocketing. In my state we don't pay take on prepared food. I don't understand how this can be legal, why not just raise their prices, so you know what you are paying up front. How long has this been going on?

hi, used to work at McDonald's as a manager and a lot of costumers came up to me with the same question. Let me clarify this for you.

the tax is legal, it's the sales tax of your state what happen is that McDonald's uses this kind of language to the sales tax. It doesn't matter whether you dine in or take out your food they will still charge the same amount of tax. the main use for this different names is for order accuracy when employees are giving the food.

In Indonesia tax that charges by McDonald's is legal. The Indonesian government decide that all restaurant operate in all Indonesia country, except Batam island must pick 10% of taxes from the customers, and then they have to deposit it to the government.
I don't know well about other countries' taxes rule, but I think every country has their own rule. And McDonald's has to obey it where ever they do the business.

Speaking for my area in Ohio, there is sales tax remitted to the state, for food and drink consumed on premises.

On carry out food - no tax is to be charged. There is still sales tax charged on soft drinks, regardless if eat in or carry out.

I have a McDonalds in my area which has overcharged sales tax in many instances.

If you are having trouble with any possible unauthorized tax being charged to you, get with the county auditor or state auditor and detail the problem to them.

There are certain instances of local or other taxes, that may be in place. Check with the auditor. Don't give up any more money to any business, than is legal or necessary.

its not a tax. they just mean your dining in or eating out. then the word tax next to it is the tax you pay on the food. It has nothing to do with where you eat the food. I asked the same thing and that is what the people whi worked at my McDonald's told me.

Yeah some states have that tax. Its called a snack tax. Its legal. Shouldn't be. Well its unhealthy food I guess. You won't get taxed on Milk though.

They are just ripping you off if any of them charge you tax on carry out food. I don't believe it's legal.

It is not legal to collect a sales tax unless it is authorized by a city or state.
