"Adverse possession" is gaining title to abandoned or unclaimed real estate by a legal process of assuming title. Has anyone here on Yahoo Answers done that? Is it a difficult process, or relatively simple (given the title search, filing court documents, etc)?

no. that is not what adverse possession is, really.

adverse possession is best illustrated this way: farmer joe owns 70 acres that is next door to your 100 acres. you share the lot lines per survey. farmer joe also owns the land that sits behind both your and his parcels.

well, you are not around. so, farmer joe starts to drive his tractor onto your land, sort of making himself a path, to his other parcel.

you are not there, so you do nothing. you do not put up a fence, for instance.

after a given length of time (defined by local statutes), farmer joe may gain title to the part of the land that you own via adverse possession that he drives on.

the "possession" of that part of your land by farmer joe must be use of long duration and in essence, by him trespassing on your land.

just because you go walking every day on someone's vacant land doesn't mean, whatsoever, that you therefore can gain title to it. nope, no way. if that happened, that would be tantamount to being able to steal real estate. if wishes were fishes, we would all be casting nets, no?

YOU MUST BE ABLE TO PROVE THAT YOU HAVE PAID ALL THE PROPERTY TAXES ON THE PROPERTY FOR A PERIOD OF TIME AROUND 7 YEARS.
