My bf has been seperd from his wife for almost 2 yrs now and they have a son. But she will not sign the papers bc she want full custody. Bc she is mad that he is moving on with his life. His son is his world. He means every thing to him. She uses thier son to get what she wants. She goes out and stays out till 3-5 am, and does what ever she wants. She knows he will not agree to full custody. and knows that the longer she drags this out the longer she is in title to all his money and that he cant fully move on with his new life. it is not far to the kid or to us. what should he do or what can he do. to get the divoce and joint custody.

Custody and divorce remedies vary from state to state. In my state, the matter can be brought to the Court in the form of Temporary Orders. The judge makes these orders so there is no agreement of the parties. If there is a decree waiting to be signed, our state allows one party to set the matter for hearing. Again, he will make a decision if there is no agreement. Mediation is also a good resource because it gives both parties a chance to lay their cards on the table and talk betwee a neutral third party. I would contact my attorney and ask him how to resolve this matter. He should know how to get this done. If not - get a new attorney. It's important to remember that the one really being hurt here is the child.

He could give her full custody, there is not that much of a difference, he will still have visitation. It can still drag on and on until the kid is 18. The beyotch is using the kid to punish him, and the fight with her has become a lifestyle for your BF. He needs to be fed up with it before he will actually do anything. good luck, dear. One piece of advice, do not be in a hurry to marry this guy, this sh!t is not going to get any better if you are married to him, this is the voice of experience talking.

I would hire a private eye to see where she goes and who she is seeing and see what goods I could get on her for being an unfit mother and try to get custody of the kid. I would also play hard ball and not talk with her or having anything to do with her. I would go through my attorney and see what happens. Especially if you get the goods on her!

She does not have to sign the papers..
He can divorce her without her approval or signature...

you move in court for final judgement, they request continuance, the judge allows or denies, etc etc.
