Does anyone know what joint primary and physical custody mean? Does that mean the party who is asking for joint primary will recieve primary custody? I am confused...

primary custody regards decision making powers of the guardian. it decides who has the power to make decisions in regards to schooling, religion, sporting activities etc.

physical custody means who the child lives with.

joint physical and primary custody means that both parents share the decision making powers and the physical custody.

Joint Primary is both parents have custody of the children while living in seperate domiciles....The parents create a custody schedule(weekends, b-days, holidays, father's day, mother's day vacations etc.) There is agreement between the ex-spouses to supply health care ,and to usually maintain a life insurance policy to be left to the children on the event of the death of the parent. These couples also shouls agree on educational expenses and clothing for the kids...The notion of joint primary custody assumes that there is an amicable divorce...

Physical custody, usually given to the female but challenged more often than not by the father provides that the custodial parent redeive monies, and all other support necessary for the well being of the child.....This has been a challenge for years because of dead beat moms or more likely dead beat dads skip their support payments and force the custodial parent and the children into poverty situations......

joint custody does not mean that one parent has more rights than the other one. It means that is who the child lives with most of the time. It does not mean that the one that is asking for it will get it however it is usually whom the child has spend more time with, more often it is the childs mother unless the child was living with only the father when the couple split. It is harder to decide on whom the child will have primary care with if the parents were not married which is more common these days. For me it was that because me and my ex were not married and did not live together the childs primary care was given to me. The decisions on medical care etc. must be decided by both parents because the custody is joint. I used to fight my ex about custody all the time and when you are mad and bitter then you are motivated by your emotions, but he did stick in there though and he is a wonderful father whom has been consistant. I did give him a hard time and I feel badly about that but with time and healing we were both able to see what was in our sons best interest, and it was for him to have both of us. Primary or legal custody refers to who gets to make decisions regarding the child's welfare and upbringing.

Physical custody refers to who actually takes care of the child, where the child lives, who actually pays the living expenses, etc.

Joint custody means both parents, as opposed to single custody which is only one parent.

So, joint physicall/legal custody means that both parents can make legal decisions regarding the upbringing, just like when the parents were living together. And joint physica custody means both parents are individually and collectively responsible for the child's physical care and housing, just as if the parents were still married but living in different buildings.

Joint custody is the best for the child, if the parents can get along well enough to work together to make good decisions.

For me and my ex, it means that we share our daughter 50/50. We each do not seek financial help from the other, and assume all financial repsonsibilities for our child when she is in our custody.
