my husband has been out since January on FMLA leave, he has been approved for intermintant leave and he takes his leave when he has to adjust to a new medication level, he is bipolar. Anyways the first day that he took FMLA and knew that he was approved his supervisior said no he needed to come in anyways because they didnt physically have the paperwork although they had been contacted by HR. He took off anyways and HR reemed the supervisior for attempting to deny his FMLA. When he went back to work they gave him a repremand, and since then have attepmted to write him up when he complains, and have initiated 3 different investigations against him which never state what he actually did wrong. The most recent letter of investigation was given to him because he requested an investigation be done on another employee who came into the office he was working at screaming and threatening him. This girl is the bosses pet, what do we do if he files a complaint he will be written up again.

CALL HUMAN RESOURCES. document document document. Document and get the documention notorized so that the HAR people know you didn't just get mad one day and do all of this writing, that way they will know you have been actually keeping record of this over time.

What your husband's boss did is totally illegal - it's also incredibly common. Workers who actually exercise their FMLA rights are routinely harassed by the bosses, to make them quit so the company is no longer liable for their medical coverage.

Get an employment lawyer. I have a friend that is one and this is wrong! Once you show them you have a lawyer, they will back off, especially if they are a large Corp. No one wants the bad publicity that Wal-Mart is currently getting due to their mistreatment of employees.
