How can Fergie steal Ludacris' rap from Luxurious by Gwen Stefani, and claim it for her song? The song Fabulous and the Luxurious Remix are almost identical. I heard the Stefani song about 1 year ago on 92Q jamz and thought it was good. Then a year later, I hear the same beat and the same rap by Ludacris, however with Fergie singing. Isn't this copywright?

I meant "Glamorous". She can't come up with her own topic to sing about, and have a different rap by Ludacris? That desperate?

The album version of Gwen's "Luxurious" is a solo and does not contain a rap. When it was released as a single, her record company - Interscope - wanted a rap added so the song would appeal to a broader market. The Ludacris rap was originally offered to Gwen but she decided to go with Slim Thug instead. DJ Ideal created a remix with the Ludacris rap anyway to see how it would sound. Gwen hated the Ludacris remix and did not allow it to officially be released. But you know how things are in the music industry - songs are always getting leaked without the artists' permission.

Polow Da Don produced the Ludacris rap. Since Gwen didn't want to use it, he offered it to Fergie. Polow and Ludacris own the rights to it and can do whatever they want with it. Gwen wanted to supress Ludacris's rap while Fergie featured it prominently in her song. With Fergie the rap portion got mainstream radio/TV airplay and has earned major $$. "Glamorous" has already been higher on the charts than "Luxurious" ever was. In the final analysis it was a smart business decision for Ludacris - he is lucky Gwen turned him down.

As for Fergie "stealing" that's, well, ludicrous! The music industry is very cannibalistic and incestuous. Songs, samples, raps, verses, lyrics, titles, and melodies are frequently being shared and reused. With the proliferation of the Internet and music getting leaked, it's just become more noticeable in the last few years.

First of all I think that the song you are refering to is "Glamorous" and Ludarcris owns his raps not Gwen so I think that if he wants to reuse it then he can. He wrote so why cant he use it.
