So a cop came up to my car because I was pulled over talking to someone on the road. He got all the information he needed from me and then brought it back. He didn't give a a ticket or warning for anything. He arrested the person I was talking to. I quess for public intoxication. He took the ID's of the two other people in the car. He knew one the of people and gave his back. But he took the other one and ran it thru the system. He brought it back and said that I could have been arrested because the person in the back had a open bottle of wine in the backseat with him. Then he said the only reason why he didn't arrest me was because I seemed to be sober. Ok I understand it would have been different if I had been drinking but I wasn't. I was driving two drunk people home.

No difference. By that having open container in the backseat, you were provided the opportunity of drinking from it while driving at some point in the future. In most jurisdictions the law says that any open container must be inaccessible - in the trunk - and even then, if they smell alcohol on your breath they could maintain you just recently put the open container in the trunk after drinking from it. Best policy - no open container in your car at any time.

It is illegal to have any opened alcohol beverage in the car. The person with the opened alcohol beverage was breaking the law. In these days, there is a zero-tolerence policy.

I didnt think you could get arrested either ,but yeah you cant leave with a bottle of beer even from a bar because it considered open flask or something like that .

It is illegal to have an open container of alcohol in a vehicle - he could have taken your car an had it towed in and taken your license also - you were very lucky - thank the policeman/woman for that!@~

In some states it is illegal to carry alcohol in a vehicle , just depends on the state , but most states are this way wether its open or not its alcohol . check your state to see the laws.

That law varies greatly from state to state, in some, any open container, in other states the open container has to be within the reach of the driver, and some states like TN it is not against the law to have any open container.
