i am divorced a male with 2 girls living with me no child support at this time.If my ex remarries does her new husbands income count if i take her back to court for child support

Simple answer is yes. It has happened a lot and would have happened if she had custody of the girls and you remarried.

PS It DOES depend on the state you live in but from those I'm familiar with in Tennessee and Texas ALL household income becomes basis for a reevaluation of child support. I've had two girlfriends in that position when they got married their income was factored into what their husbands could pay in child support.

Yes, I believe so. How is she living now without a job? They will ask her for a source of income and she can not get away with saying she doesn't have a job and her new husband takes care of her. She could never have a job and never have to pay you a penny? Yea right. Texas when I filed, even if the ex didn't have a job, the kids are still their financial responsibility as well. The court will give so many months to find a job, if she refuses, they will still give her a monthly amount to pay. If she can not pay it, it accumulates as back child support. She will have to pay back child support for the months she is not paying you. If she is married it does become his responsibility indirectly. The key is persistence and how serious your state takes child support. Texas seems to.Good luck

It really depends on the state you're in and how good of an attorney you have. You should probably worry about getting support to begin with, not in the hopes she marries a wealthy man. I know that my husbands ex tried to get my income as well (and boy did that fly with me). We took care of that little issue though...I was willing to divorce him and stay living together for that, although it didn't come to that in the end.

I think you differs by state when I lived in Connecticut you couldn't BUT in Wisconsin they do count the spouses income. So I guess you'll have to check whatever state your in. Go to a Law Library and look it up or just call your local Child Support Enforcement Agency.

sorry, but, yes is the wrong answer. Her new husbands income has nothing to do with child support for your children. Ask any attorney and they will tell you the same.

In a word, NO. The only one that counts is if your ex's gets a job.

no , you cant touch him .. or his income , you can only talk to the CSA , if she is receiving a benifit from centrelink , then you can get a portion of that (it isnt much or even worth it) , if your not on the single parents income , then get on it , if your in australia , have a look at the CSA website , and centrelink websites , for parenting payments.. feel for you buddy !
