What is the fine for grand theft check writing charge?Last year I was told by an overseas client that I had a wire pending. For $70,000. Since he had paid previously in amounts of $35,000 and $15,000 on 4 occasions I had no reason to think it wouldn't. When he gave me confirmation I wrote a check to my mother in law
for $16000 and to my wife to be put into a savings account. When he at first said the wire was delayed I told the bank to hold and redeposit. When he said he couldn't I asked everyone to cancel checks. The bank wouldn't cancel the 2 checks. And then apparently have tried to charge me with grand theft - I guess they don't know it's my mother in law and think I tried to defraud - does anyone have any thoughts? I've never even had a jaywalking ticket but to sleep at night would like to hear this will be dropped or if anyone knows the fine I can pay to avoid a jail sentence for something I didn't do - I have an autistic child and want them to stop

cesare214: International banking law does not apply in this case. The wire transfer is NOT relevant to the charges. The overseas client is not the one on trial. The case is about writing checks without money in the account.

Check fraud is punishable be prison time. You won't receive a fine.

You were conned by the old "Nigerian Money Scam" I get two or three of those phony story emails a week.
But, I seriously doubt that you are in serious trouble for those two checks. A good lawyer would make mincemeat of a bank dumb enough to do any more than return those checks as "Insufficient funds" to pay them.
I know a judge who would laugh them out of court.
If you get a public defender it shouldn't cost you for legal fees and a fledgling lawyer fresh out of law school should get you off with a light fine.
If you do have trouble past what I said, get my email from my ha_mer Yahoo account and send me a message with the complete story.

They do NOT care about jaywalking nor your child . . since you are writing large checks BEFORE you have a deposit to cover them.
For that amount , there may be jail time . . .
You should seriously get an attorney and plan NEVER do something that stupid again.
The only thing dumber would be driving drunk and kill someone, then say 'but I haven't even had a jaywalking ticket' - meaningless . . .

Ya, get a lawyer, and tell your child it will be all right. When I had tax troubles, my autistic 10-year-old went crazy with anxiety until he was finally able to type for me what was wrong.
