Two people blaming someone in the state of KY for two counts of theft by unlawful taking. The discovery just came in and all they had were them talking to the grand jury. The record for the person being accused is clean. What will happen, will they drop it since it is mostly she say he say, or will they send this person to jail, please give me any info you have. Thank you in advance

I am sorry they indicted him in August 2006

Full acquittal.

They've got nothing.

While Grand Jury testimony is evidence, the Prosecution and Defense have equal argument (he said, she said). The jury will disregard both arguments. So you are left with two things. The GJ evidence against the defendant's clean record.

If I were the defense attorney I wouldn't lose any sleep before trial, and I am not an attorney at all

I can't answer for Kentucky unfortunately, but possession is 9/10ths of the law. If the items were found on the person or in their legal residence, then the law is going to side against them. However, the sentencing could come out to be more lenient with a clean record. Most first time offenders will not clog up the jails, get off with community service and a fine, plus restitution.

It also depends what was removed, and how it was removed. If it's something small-ish, then the sentence will reflect that. Something like a car is going to levy a much stronger sentence, as will threatening or breaking and entering, or even trespass.

If the Grand Jury did not see fit to indict, the charges may be dropped. It's rather miraculous the District Attorney failed to get an indictment because they usually can get a ham sandwich indicted (with or without the mustard).

I dont know the laws their but usually as long as they have no
record , they will give them probation and a fine rather than jail sentence.
