this would assume equal justice. I don't know the Oregon statute but the sentance would be different depending on the owner of the arm. If the arm belonged to a prostitue, the governor of the state, a drug dealer, a wealthy housewife or a working class black man the charges and sentances would all be different. In your particular case it would depend on previous criminal history, if the victim was a mutual combatant or if you are charged with aggravated assault or mayhem. The action doesn't determine prison length the criminal charge is required to be specific.

Depending on your jurisdiction there could be a variety of charges you could be charged with. I'm only familiar with Australian law, but in Australia, you could be charged with - assault with a deadly weapon, aggravated assault, assault occasioning actual bodily harm, assault occassioning greivous bodily harm, attempted murder....it depends on the situation and the extent of the injuries. If you are under the influence of alcohol, this may limit your liability in that, you may not be fully aware of what you are doing. However, you would still be open for a civil case on which you may be liable under the tort of trespass to body and made to pay damages. The alcohol will hurt your case, they will say you would not have done this if sober therefore it is your fault for getting loaded. It depends on where you were at the time, why you did it,was it your knife? Was it self defense. Did you do it in defense of another. The charges won't be pleasant, it depends on your state. It's a felony. You might plea bargain down if you are in a big city.

It depends on Where you are(state), what your history is(are you a criminal, or have a criminal background) What you used to stab the person (ie pencil, of Rambo knife) Were you in any danger( was this self defense) Was it premeditated (did you plan it)(like if they check your computer and find this)Finally are you likely to be a danger to someone else or the person you stabbed.
