to file as a non profit org. and currently working in allignment with established non profits. I would like to know if I can file as
a non profit before I file with the I.R.S. and with only three of us?

In order for your contributors to have the assurance that their contributions are tax deductible, you must have IRS approval as a 501(c)3 charitable organization. Can you operate without it? - yes - but it will make fundraising very difficult and you could be subject to tax for any income received.
