When we got divorced in 2000, we got joint custody. With him being the custodial parent. I had some problems. Everything much better for years now. Kids live with me, and have for years. I have not gotten one dime from him to help support children. One is 15 and one will be 18 in May. I am doing my best, and did not ask for anything, except to claim them on my taxes. He said Nah, I don't think so. Like he has a right!!
He pays medical and dental. He thinks that is enough...They never sleep at his house, and has hardly any relationship with him. He is also remarried with two small children. I did not want the court drama, but feel like I deserve some help...Any input would be greatly appreciated!! Thanks!

you'll have to go back to court for modification. you wont be able to get back child support, but you should be able to get child support. The only kink you may find is if he fights you for custody and makes the kids go back with him. But if he hasnt done it yet, he probably wont/ can't. He has to prove that what he has to offer the kids is way better than what they have now. I'm not saying money-- he has to be able to give them a better LIFE, and from what I've seen, thats hard to prove. But if hes left the kids alone for this long, hes satisfied with the situation. Why would he fight to change it now-- simply to get out of child support, and the judge will see right thru that. Take him back to court. Or at least go thru your local Dept of Human Resources and file for child support. It might take a few months, but when you get the order for support, it will go back to the date you filed.

Youre going to have to go back to court here for; 1. to prove medically that youve overcome your past problem that prevented the courts from awarding the kids to you in 2000 and then go for custody yourself and sue him for support. But from 2000 to now you, basically, screwed yourself but did so out of the goodness of your heart but that doesnt mean much in a court of law. Hopefully your kids recognized your goodness. Since he has or is the custodial parent, he has every right to claim them on taxes, sorry. What youve done is admirable but wont help you much in court. Basically you will have to start all over from this date with cusyody and support. Wish I had a better answer for you but the law is what it is. Good luck

You should have had it changed on paper when they first moved back with you. Since you didn't, do it now. You might even be able to get back child support if you have proof of how long they actually resided with you.

Been there and they may only allow me to collect from the date i filed for support, or in my case, modification of support.

check your state statutes.

you have to go to court to get it changed.
