It's not illegal unless it violates the Civil Rights Act which, by the way, includes "sex" - go figure. Generally, women are discriminated against more in the way of promotions than any other area. Maybe all that will change when single, childless, men receive 12 weeks off a year and women lift their own boxes!

This answer varies from state to state. We had women voting and holding public office before we became a state in 1912. We have an equal rights amendment in our Constitution, so for us, since at least 1912. It wasn't enforced, but the Fair Labor Standards Act of 1938 also mandated equal treatment.
