against humanity in the world court? I believe that it would be handled under Int'l. law, like from the Hague World court, but what would be needed to get a conviction of Bush & a world court war crimes trial for him? Could they do that to a US President?

No, for three reasons.

First, the US is not a party to the International Criminal Court. We don't recognize their jurisdiction, for exactly this kind of reason. So, some country would have to try to invade the US and kidnap the President and drag him before the ICC. That'd be interesting....

Second, Congress amended the War Crimes statutes in 2005 or 2006 to retroactively immunize anyone who had committed war crimes, including those who committed them before that point. No military person or federal officer can be tried in US courts for commission of war crimes, as originally defined under 18 USC 2411.

So, although Bush admitted to actions which were felony war crimes at the time (as per 18 USC 2411), and although the Supreme Court confirmed that Bush had violated section 2411, the actions of Congress granted complete amnesty for all such actions.

Third, a sitting or past President cannot be tried in criminal court for actions committed in the course of his duties. That's what impeachment is for. So, even if he hadn't been granted retroactive amnesty by Congress, he's outside a prosecutor's reach.

I'm probably digging my own grave by saying this, but he could only be charged for war crimes and/or crimes against humanity if they were part of United States law AND considered a high crime or misdemeanor. Having an international court handle it kind of kicks George Washington's entangling alliances warning right out the window; besides, since when are we so weak that we can't handle something like an impeachment by ourselves?

I think he should be based on his taking the U.S. to war based on his lies and for his crimes against the Iraqi people and his crimes against humanity as a result of that lie. If you can find somebody to arrest him, then I would say yes it could and should be done.

Edit: I think that his cabinet and his Vice President, and especially Donald Rumsfield should be included in any trial also.

the project is there could be no concensus on the punishment. i'm hostile to the death penalty, because i understand that individuals rot in penitentiary and develop into "goofy". So why even difficulty killing them (is one argument)? there are a range of arguments about the death penalty. For me, in spite of the crime it truly is euthanasia no count number number what, which hence constitutes us as figuring out which human beings stay and which ones die in line with thier condition. it truly is no longer proper to me. like it or no longer, those who dedicate henious crimes are us. they are different human beings who're screwed up. obviously, once you've spoken to some them which I particularly have, properly, no longer all of them experience they are screwed up. they are going to inform you "too undesirable he deserved it for what he did to me i could care a lot less about what the regulation says". and positively, the project the following is, we could obey the regulation. to guage and comparison those very last 2 statements, sure we could obey the regulation. we gained't have lawlessness it truly is insane. on the otherhand, can we impose the death penalty on someone who could no longer administration his easily organic human impulses which became to shelter himself. imo, we could placed the guy away, yet no longer kill them.
