I got a friend of mine hired on into and oil company that i work for. During his first month, they are trying to let hime go (put his employment on hold) because he had a previous felony conviction. They stated that he did not let them know of the felony b4 he was hired. He did because i took a detailed look at his application. Now that he has fowarded all of his previous emails to our HR services to let them know that he was trying to hide nothing and that it was stated on his app, what are the chances that the company will still let him go? If you have any advice for him then it is greatly appreciated. Especially from anyone that has any legal experience.

If this is an American employer, remember that with few exceptions, all public sector employment in the United States is "at will", which means an employer can terminate employment for any reason, without explanation. My advice would be for your friend to start looking for another job.

Contact an Employment law attorney in your area and have them evaluate the situation to see if your friend has a case.

Most attorneys will evaluate the circumstances for free and let your friend know if he has a case or not.

even if it was an oversight on the hiring process, they still can fire him if their company policy is no one with a felony conviction is permantly hired
besides criminal backgrounds are not a protected class like race, religion and handicap are
