The president can appoint anyone. But that appointee must still be confirmed by Congress.

Read the 25th Amendment, Section 2: "Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take the office upon confirmation by a majority vote of both houses of Congress."

He can appoint anyone. Look at the case of Spiro Agnew. He resigned and President Nixon appointed Gerald Ford as replacement, then when Ford was made president, he appointed rockerfella.

They do have to be approved by congress.

No, If He resigns, then it goes to the speaker of the house, and in this case , if Cheney resigns, then Nancy Pelosi becomes Vice Pres.
