I am currently 25 yo. and I attended one year of college when I first got out of HS. I did VERY poorly. I think only one or two classes would transfer anyways. I also am pursuing a completely different major. I think I would have a better chance of getting in based on my HS record (very good), my essay and my life experience.

You can apply as a Freshman, but it all depends on what you want to give the other college that you are attending. If you want them to have the transcripts from your other college so that you can get credit for the classes you took, if you took more than 30 semester credit hours, chances are you are not going to be accepted as a Freshman, but if you don't give it to them, they won't give you any credit for it, and you can go in as a Freshman.
Just start off with a fresh record, it will be easier for you.

Of course you can. I did it. Just don't tell them on the application that you attended previously.

I was in the same situation. I did terribly in the first college, took some time off, then went back to school.

But I wanted a fresh start, so I didn't mention the first school.

Yeah. I know several people who did. Best, they all proved that now they can do a lot better. Most colleges will have no problem with it.

You don't even have to tell them you went to that other school.

If you say that you want to come in as a Freshman, they'll
have no problem with it, and they'll have no reason to
believe you've been elsewhere.

Yes since it has been awhile since you've been in school. You won't have enough credits to be a sophmore.
