I have seen a few people riding their bikes while on a mobile. Does this come under the new law covering the use of phone's whilst driving. If so, are the penalties the same?
(I'm not intersted whether this is right or wrong, only what the legal stand point is).

No, it's not illegal. The phone law only covers motorized vehicles. However, if you knocked into someone whilst using a mobile on a bicycle, you could be done for riding without due care and attention. That would amount to nothing more than a small fine though. And probably a handbag across the head from the little old lady you knocked into, if you live where i do.

Yes you can: There is no provision in the legal system to cover mobile phone useage on any machine without an engin

A biker is a road user, in traffic... I'll wager it's illegal and it will be interesting to see the cops working on that one. If a biker caused an accident and someone died due to using a mobile, watch them throw the book at him then... and rightly so as well!

no under section 7.2.39 of the mobile phone act it is not illegal as you are nto actualy in control of a vehichle
for some reason you are able to ride your push bike on the road and use your mobile phone as it is not clased as a vehichle its mad i knw

It is not illegal as such but you can be done for careless riding or riding without due care and consideration

it should do as you can still be breathalysed in charge of a bike
