future court decisions could be based on co-habitation if it came to that? makes sense?

Changing from a registration-based system to a co-habitation based system is complex, and the latter has been shown to be full of problems. That's why most states eliminated the concept of "common law marriage", which is a co-habitation based system.

But you're right -- eliminating the legal status of "marriage" would solve lots of discrimination problems. Limit so that states can only grant civil unions. If you want legal benefits, get a civil union. That leaves "marriage" as strictly a religious concept, and whether you are married or not would be between you and your church.

So, who's in favor of a Constitutional Amendment prohibiting any state or federal govt from granting any benefits based on being "married" and make civil unions available regardless of the gender of the participants. That seems to solve all the problems.
