If the RIAA conctacts you and says that they have tracked you downloading illegal movies, what are the chances that they will sue you? A friend of mine was contacted by the RIAA via e-mail. Will he get fined and/or sued?

The letter said:

Comcast has received a notification by a copyright owner reporting an alleged infringment of one or more copyrighted works made on or over comcasts highspeed internet service. The works copyrighted by the copyright owner are: .......... comcast reminds you that the use of the service in any manner that constitutes an infringement of any copyrighted work is a violation of comcasts acceptable use policy and may result in termination of your service account.

what's going to happen to him... anybody know?

If it was movies, it was probably the MPAA that contacted Comcast.

There is a good chance he will get sued (smaller chance of any criminal prosecution.) His best bet is to be open and cooperative, and promise not to it it anymore -- but he should be careful about how his does it.

If he has done a lot of this, he may want to consult a lawyer to handle the negotiations. But my advice is for him to accept that he's been caught, and plan on not doing anymore illegal downloading.

What did the letter ask? If it said to "cease and desist" he probably should say he will cease and desist, though in doing so say he is not admitting he did anything. Whatever he does, ignoring the letter is the wrong choice.

Notice of Action under the Digital Millenium Copyright Act.....ABuse number: ---

Dear comcast highspeed internet subscriber:

Comcast has received a notification by a copyright owner reporting an alleged infringment of one or more copyrighted works made on or over comcasts highspeed internet service. The works copyrighted by the copyright owner are: .......... comcast reminds you that the use of the service in any manner that constitutes an infringement of any copyrighted work is a violation of comcasts acceptable use policy and may result in termination of your service account. This is only a notice from comcast saying that some copyright owner has contacted comcast...so he hasnt her from the copyright owner yet. What do you think will happen to him? Sued? just a warning?

If they contact you, you're done. A fine would be the least of your worries. Try a fine and about 5 years behind bars with no alcohol.
