does that rule them out for being a sociopath?

Technically, yes, that would rule them out... BUT... a true sociopath would be perfectly happy to lie and pretend that they care about the rights of others in order to get what they want.

Real sociopaths do not care about others, they have no conscience. Isn't correct to diagnose someone as sociopath if the person cares about others. Sociopaths only cares about themselves, and that's can include their friends and families too, therefore, I guess the answer is no. A serial killer will always have the instinctt to kill even thou he doesn't kill anymore because its in jail or has something holding them to kill, their nature instinc is there, and their change of behavior doesn't make them not to be what they are.
