do you have to have a lawyer if your ex husband is contempt of a court order on child support and you want more money when he is not paying the max

You have to have a layer if you need back child support and if you want to raise the amount of the support. However it is up to the judge wether to raise it or not. The father is to contribute to helping raise the child but so is the legal custodian.

You could go to the clerk of the court where the order for support originated and ask. But I think if you want to increase the payment amount I think you would need a lawyer.
There are some lawyers that will take your case if you will do some of the work on your case, You will have to take their advice on how to do it and then they will attend the hearing with you for a lesser amount of money

It couldn't hurt to get a lawyer for both issues -- the non-payment and the increase in the amount. The court isn't going to raise the amount he is scheduled to pay uless someone asks them to -- and that someone will pretty much have to be a lawyer.
But I have to ask-- what makes you think he will pay the higher amount , since he isn't paying the lower amount?
You should talk to a lawyer about how you can get his wages garnished.

You can sue him in court for non payment, or contact your local child support collection agency. You can petition the court for a hearing for remodification of child support to amend the amount being paid. There is no guarantee that the amount will be adjusted, especially if he still is making the same amount as before.

I think if he has one then you should have one too. However, you want more money, your going to end up getting nothing b/c if he gets locked up how is he going to pay you. It's up to you but don't go against him by yourself, if he has one.
