Hello, I have gotten in trouble with ace cash express and now i owe them money. They keep processing the check to my bank account for the amount owed. They indicated they can keep doing that as long as they want and my bank charges me NSF fees each time! I know i need to pay it but i owe them too much that i can't pay it all at once and they don't want to take partial payments either. They already sent it to "Recovery" and this guy i talked to told me if i don't pay it i should start seeking a lawyer! What should i do please ???

FIRST THING GET ALL OF YOUR RECORDS FROM THE BANK. GET ALL OF THE RECORDS (LETTERS) THAT ACE HAS WRITTEN TO YOU. What they are doing is wrong and a judge will make them pay for the bank charges.

Write a letter to Ace stating how much you can pay and over what time ($20 per week until paid). Make sure that this letter is delivered "return receipt required". Keep a copy of this letter to show, make sure the letter is dated, signed and notorized. Have your show copy notorized at the same time as the one you are going to send to Ace.

Ace does not have to accept your letter, but they can not cause you problems, this is against the law. If the bill is in the hand of a collection service, DO THE ABOVE AND write a letter to the collection service. This letter has to be DATED SIGNED AND NOTORIZED. You will also have to send this one "return receipt required" and keep a copy for yourself so that you can refer to it. THIS LETTER SHOULD STATE THAT - THIS BILL ENCUMBERED BY THE LAWLESS ACT OF "ACE" PREVENTS THE PAYMENT UNTIL THE COURT RULES ON THE INJUSTICE THAT WAS DONE TO (your full name). Make sure to sent copies of the bank nsf bills with this letter to the collection company.

If the collection company tries to collect, do not pay until there is a court hearing. You can file in small claims court, make certain that you put the amount you put in the letter to Ace in a secure area (not the checking account). You may have grounds for additional penalties, check with Legal Aid.

Do not agree to any fees by any collection agency, and do not make any payment to anyone except ACE: AND Only if they write a bill of payment to create a proper payment order. Although you may owe $2,000 - paying $200 a month is not reasonable if you can't live well on the balance of your income. Most bill collectors don't care how you live, so you have to make sure that you take care of the living conditions.
If ACE write you a payment agreement make a copy of it and send it to the collection company, this will get them out of the mix.

Make sure ACE deducts all nfs fees from the amount you owe; ALLOW ONLY TWO OF THESE FEES if you go to court. The fact that Ace would not work with you is only because they don't understand their business.

I have had this happen to me. Don't worry. If you really really really can't pay this, then let them send it to the court, and the court Will set up an affordable payment plan. You absolutely do not need a lawyer for this--that would be a waste of money. I know it is scary, but if you don't have the money, then you don't have the money. Just go ahead and let the courts give you a payment plan that you can keep up with, since Ace Cash won't.

Oh, and don't worry--the court date will not be just you and the company, there will be probably 30 other people in there that are also having financial issues, and the judge will call everyone up, one by one, talk to them for around 3 minutes, asking whether or not they owe the money, and then he will send you to talk with the people to set up a payment plan.

Call lawyers in your home town, your right to stop payment of the check will be governed by your state's law. Most bankruptcy attorneys in your town will know the answer. Call several until two or more give you the same answer.

By continuing to process the check they increasing the pressure for you to pay and to pay their extra fees. Get an extra job, part with some of your prized possessions by selling them to friends or resell shops and remember that these "pay day" loan companies are making billions of dollars by doing just what you describe. It's never a winning situation for the borrower.

Find a good surgeon and a physical therapist because you are going to get your knees busted.
