....unless they can show that you were aware that the recording was taking place.
If such a recording (a candid one) were to cause damage to you they can be held liable in a court of law.

The short answer is yes, if you are in a public space; if you are in your home, no, needs your permission; when you go into a store, airport, bank, etc, you impliedly give permission for surveillance when you enter a business establishment; if you go into a friend's home or stranger's home I think they could record you for security purposes, but more than that, say while using the bathroom, could be a violation of the state's privacy laws.
