I would love some help and advice my father has worked for a company for 17 years and has given 100% dedication in those years working alot of shift work under extreme pressure and also doing the job of three when superiors are off! Recently an accident happened at work when a fellow worker hurt his hand but returned to work straight away and apparently it happens almost every day. He was called up to office and was told they would get back to him. My father continued to work and was even asked to do overtime that very weekend. TWO WEEKS LATER he was given the sack after 17 years of service with excellent attendance record and no disiplinarys. Is this not fair one accident in 17 years and he is given the sack does he deserve this????? If you can give good advice I would appreciate it as my father has always been a good hard working man and does not deserve this!!!!!

The accident in question - My dad works a machine and the guy who got hurt entered machine without my daddy knowing and my daddy operated his end there is a safety key which the guy was in error with!
Clear record??? Someone replied to question my dads clear record I can 100% assure you he has had no grievances/disciplinarys in the 17 years service his only downfall is living and breathing for his work missed out on alot when we were growing up working 12 hour shifts believe me when I say it I am not only defending him because he is my father and I love him but he is such a good man, unselfish, hard work and any money his good money he earned was never spent on himself he lives for his kids and grandkids and spoils them rotten it is breaking my heart to see him treated in such a way!!! Also he did report the accident unlike alot of fellow workers who do not own up!

Also three days after my daddy had been sacked three woekers were caught doing the same thing and someone told health and safety men. They got a telling off nothing else one rule for them and another for my father????

I encourage you to go to the Ministry of Manpower to see if there is a case.

See if you can claim compensation for unlawful dismissal. The company in question will need to provide documentation to prove your Dad is sacked because of bad performance and not because they want to get rid of him without paying retrenchment benefits.

Don't let them get away with it. If you win, that's 17 months of salary, enough to help till he gets another job.

I don't want to tick you off, but I do want to let you know there is two sides to this, and you only have your dads side. But it's obvious you love him a lot, and you are trying to take care of him.

The first thing that popped in my mind is "are you sure he's been a perfect employee?" I am sorry, but I've dealt with these situations before. And if the company is a right to work company, they have the right to terminate anyone for NO reason.

If this accident has been happening all the time, I am willing to bet the company has been putting some pretty stringent safety policies in place to cut down on the accident. And they are sick of it. Sacrificial lambs happen in business, if people see a 17 yr vet get fired, they will take better care.

I would like to agree with you that your father don't deserve such treatment, but you should also know the society is cruel. I am not the investigator of the incident, so can't comment on your fault was that. But as an employee, we are always at our employer mercy, any mistake we made could cost us the job. 17 days or 17 years, to some employer, the only different is 17 days is much more cheaper than 17 years.

First of all, I agree......he doesn't deserve that sort of treatment. I hate when companies won't be as loyal to the good employees as the employees are to them. My guess is that after 17 years, your Dad was probably making more money than alot of the other guys and they decided to sack him so they could get other guys to do the same job for less.

It depends what your father did. If it was an accident, I don't see the company sacking him. If it was something maliscious or fraudulent in the claim, then the company could terminate him.

Was your father the supervisor on duty? Did he make a report about the accident? Did he not follow company guidelines in the event of an accident? There must be more to this. Need more details.

You're right that he doesn't deserve that treatment if all the things you say are true. On the other hand, companies can do just what ever the heck they please to do with certain limited exceptions in the area of discrimination. He might speak to an attorney to make sure he gets all retirement and other benefits.

Depends on the state. In Oregon they don't need any reasons to fire you. Depends on the accident as well. There is a lot of info. that would be needed to answer your question.
