Obviously no-one can make a company hire someone who's been in prison for whatever reason, but is it legal for them to not hire someone solely because of a criminal record?

Sure it is legal, being a criminal is not a protected group.

Oh please be careful. MANY states do make it against the law, under certain circumstances, to not hire someone because of their criminal record.

It may not make sense, but in many states, it is against the law.

There are often ways around the law. For example, a bank can decide to not hire a convicted embezzeler because it requires that the persons hired have strong moral character. But in those states where discrimination due to conviction is against the law, the bank would fail to hire due to the ACT of embezzeling, not due to the CONVICTION. But even then, it will need to show that the reason has something to do with the job.

For example, where it is iillegal to discriminate based on a criminal conviction, you could not refuse to hire someone who is a convicted embezzler as a --- school bus driver -- since the crime has nothing to do with the job. Of course, you could decide not to hire the person due to lack of recent experience (hard to get experience while in the slammer). But you would, in those states, be on thin ice indeed.

It can also discharge or fail to hire simly due to failure to disclose the conviction on the application (untruthfulness of app, not conviction).

It depends on both the state and the job. There is a Federal law that prohibits banks from hiring anyone who has been convicted of a Felony. I'm sure security jobs can be denied based on criminal records. Armed guards can't be Felons, because Felons can't carry guns.

no it is not against the law for a employer to discriminate against a ex con, however there should be , unless the ex con would be in a position to do harm to said company, for example, a man runs over some one with a car, the courts most of the time will find the man guilty of manslaughter, or reckless endangerment, but now one knows exactly what happened , yet when the man doe;s his time it is difficult for him to find employment so he can supp port his family,there are so many stupid laws in our country no one is exempt from going to prison no matter how hard they try or how honest they are , many times it is just simple bad luck, but, our ignorant so called citizens so many times say he is a con, stay away from him, when this could be a very good person,
