Why aren't there stiffer penalties for DUI? My friend got hit by a drunk driver who had his license suspended because of two previous DUI's . Why wasn't he locked up after the second DUI? Drunk Drivers are a threat to society. I say lock'em up after their first offense...don't wait until someone gets killed!

The penalties are set by state law.

If you think the laws should be changed, contact your state assemblyman and representaives. Lobby the legislature. If you state allows it, start a petition for new laws.

Vehicular assault and vehicular manslaughter are terrible crimes. But they don't attract much political attention. Only you (and others in your state) can change that.

The courts try and sentence people based on the severity of the offense, not on what the worst outcome might have been. My opinion is not very PC but here it is. I think that judges give very insignificant sentences for 1st, even 2d offenses because so many well to do people imbib and drive. ANd also because even though there are levels of intoxication all are the same under the law. If there were a fines (and imprisonments) imposed based upon the level of intoxication and these were rigidly enforced then perhaps some of the tragic circumstances that happen would not. But as long as someone who drinks two beers and is ticketed gets the same mandated treatment as someone who is falling down drunk the judges and law makers will continue to 'go easy' on first offenders. Personally, I don't care about thre issue itself. I don;t drink and drive. In fact, almost never drink at all any more. But I don't want to impose my current way of behaving on others. If they drink and drive, however, lock em up somehow.

What Jeffery C. said. But it's also the fact that the judges and district attorneys don't have to live in the real world. They eat steak three times a week. They're among the reasons I vote, even in an off-year.

Because many judges and prosecutors also drink and drive as do politicans.
