I'm just a young girl minding my own business. The new rules of random stop and search in subways and buses...is this necessary?

The subway has thousands of entrances that terrorists can get thru with no detection. Does Bush think manning only the busy entrances is going to stop a terrorist?
Soon the govt will have the right to stop me anytime anywhere to seach my bag for NO APPARENT REASON. I was just WALKING for godsake!
MEANWHILE, MEXICAN AND CANADIAN BORDERS ARE WIDE OPEN!! WHO'S MANNING THE BORDERS?

Contrary to some beliefs the Constitution did not go away on September 11th. Fourth Amendment is still in effect.

The Officers are required a reasonable founded suspicion to search a person or their belongings. Now consent could be contractually implied by the "ticket" purchased --- check your ticket or the local signage for information. Also ask the Transit Authority Information officers.

Understand that if you do resist a lawful order you can be arrested. And althougth you might not think it is lawful, it might take a judge to get you out of jail. Remember you might be wrong in the eyes of a judge.

Also, the officers are not ever going to admit they made a mistake. Some cops are jerks in this way and abuse the truth and their power. Other officers actually believe they are doing the right thing. Most are and are trying.

I suggest you not carry contraband in your purse and you wont have to experience a suppression hearing, or a strip search at your local jail.

This is going to be a LONG WAR.

As far as the random search , that is why it is called a random search , sure you have rights , such as the right to walk ,instead of taking a bus , the borders are a whole different issue , you did not state if the Canadian , or the Mexican were carrying a bag ? and for gods sake are you sure it was a Canadian and Mexican ??you know they all look alike ....right .....there are other ways terrorists get through , but the point is they selected you , so I suppose Security is ok as long as it does not include you ....correct..I do not ride the bus or use public / mass transit , I have a car , even if I go cross country I drive myself....I do not like riding in groups of people .....they whine ,and complain too much

First, it's an NYC rule. So, this time, Bush is not directly to blame.

As far as the random searches, they have been upheld as legal in courts. The argument basically is that there is no requirement that you ride the subway, just as there is no requirement that you fly on an airplane. Since the use of either transit form is optional, they can require you to consent to a search as part of your purchase of a plane ticket or subway token.

I don't think it's right either, but that's the law as it currently stands. So many people are so terrified that they are willing to sacrifice everyone's freedoms just to easy their fears. It's sad, but that's the current emotional state of the nation.

Well aside from the rant about freedom, the NYC law allowing police to do random searches in the subway has been in effect for quite a while. It was challenged in court by the civil rights angle last year and was upheld by the federal court as reasonable. Not that I'm a Bush fan, but he didn't have anything to do with this one, have to blame Bloomberg for it.

How oftentimes do you get stopped? you have the terrific suited to stay off the subway. you moreover mght have the terrific suited to proceed to be silent. could I advise you employ that outstanding until you may think of of yet another question? the reason there are random searches is using the fact the bleeding hearts say no profiling. in case you don't love it, vote for judges who won't legislate from the bench.

Ok, how about this . . .no one gets searched at any time. Searching is banned. And the fact that it is banned has to be made very public so everyone is aware of it and no one gets their rights not to be searched violated.

How fast are you going to be to complain when some thug comes up to you and robs you (or worse) with a weapon that he knew he wouldn't get caught with because searches aren't allowed?

How large of a lawsuit will you file when someone you love is blown to bits by some wacko terrorist group who were able to get a bomb onto the subway because NO SEARCHES ARE ALLOWED!!!

How stupid are you going to feel the next time a crime is prevented because another idiot was caught BEFORE they hurt or killed someone because random searches ARE allowed?

Random searches are common in many areas, get over yourself.

If this prevents even 1 attack, either through finding a bomb or scaring somebody off, is that not worth it? Is that 15 seconds of your time worth more than somebody's life?

But hey, I'm sure no terrorist has ever considered an attack in New York...

Have you ever read any MTA notices? They all say that the NYPD and the MTA police have the right to search any bags that they find questionable at any time. They're not singling you out, the cop was probably just an a**hole who was pissed and wanted to get his anger out.

Hell, let's just merge with the Middle East while we're at it! They've got the whole totalitarian regime thing down, and we could learn a thing or two from them.
