I have bought condo convertion with a tenant already with a 6 month lease. The condo didnt change the carpet before they moved in or before giving the apartment to me. It's an 2-2 apartment. I don't really know the condition of the carpet before the tenant received the apartment. I did the walk through and I saw the stains. I was told by them the have to children that were the ones who stained the carpet. They stain with paints. I have already hired a profecional cleaner and the stains didn't go away. Can I use their deposit to cover the carpet?

I would not think so, you probably bought the condo as is.

If you are expected to refund the deposit, their deposit should be used to replace the carpet. Since they admitted that their children stained the carpet, they should not object.
If the original owner who leased it to them has to refund the deposit, then I would say no you can't use it. You bought the condo "as is".

it should come from your tenants' deposit...but you will need a signed agreement by them about it...or you will need to take it to the rental's man (or whoever governs rental properties)...it may lead to court cases if the tenants are not friendly about it...if you win, it will be worth it...try to just get them to agree that you can take it from the deposit.

Do you have their original rental agreement from the first owner? You should get it and read up on what the tenants agreed to, that could be helpful too

no not at all, and you should not of accepted it that way, document as best you can even though you already accepted it that way. hopefully you will not be charged for the cleaning at a later date..
