By law there is no set age. Usually at the age a 12 a judge will take a child's desire INTO CONSIDERATION but that is not always a guarantee either, Plus there are other mitigating factors. I worked in a family law court room for 3 -4 years and have even ween cases where a 16 yr old wanted to live with mom but the judge didn't let her because in the end it would not have been the best thing for her. Depends on State laws. Most States allow the child to choose at age 12.

Just read about this and it depends on the maturity of the child which is determined by the court; so some 9 years old could decide and some kids at 13 would not be allowed to decide.

The age differs depending on what state you're in. Some states it's 12, some 13. Consult your Local Division of Family Services site.

Here in Texas, a minor child can decide which parent he/she wants to live with when they are 12. I don't know if it's the same in all states or what.

12 years old here. My stepsister "divorced" her mom, and came to live with her dad, my stepdad. She did not get along with her mother at all. The court said she could do what she wants, but he no longer had to pay child support-and he didn't receive any either.

it depends on where you live and the circumstances of why one parent has custody over another.if the other parent was neglectful,abusive or a drunk or a drug addict it wont happen.if the other parent is fit and deserving of custody and wants custody probaly at the age of 12,some places you must be 14 or older.good luck.
