im 13 and my mom said i could change my last name to my moms madien name my parents are divorced and i wanted to know if since my dad has no custody rights if i needed my dads permission to change my name.

lil girl what's the purpose of changing your name, he will still be your father thru relation, changing your name won't change that. I wish you the best, for your father not to have any parental rights may not be easy but if you rely on the one who love you the most you will be ok.

yes you do, my son had a last name change when he was 6 and we had to get permission

you must file court papers and have a notice put in the paper at least 60 days prior to the court date; you must have forms filled out by both parents; or show proof that the form was mailed to and delivered to and received by your father, but he declined to fill it out and sign it
