I work at a daycare and I have only workd there for a month and I sparined my ankle and it is a 3rd dreege sprained ankle and I went to the doc and he wrote me a not to get me out of work for 2 weeks. Thing is I have been out of work for the last 2 weeks and know I will be out for 2 more weeks. My job wants to let let me go can they do this or do I have the grounds to sue them?

Yes, they can. Since you have only worked there for 30 days you are not eligible for job protection under FMLA. And if you are not able to do the work they need to replace the position. You do not have any grounds to sue you as the injury is not their fault.

Nope they can fire you. You have not been employed long enough to go on disability, and you were not injured at work so they are not help liable. Is there a possibility that you could be put on light duty until you are fully healed? Most jobs are willing to work around people but if your staying out for a month its just to let you go. I wish you luck, and let that ankle heal!
And as far as the F.M.L.A(family leave act) you have to have been employed at most jobs for over a year or worked more then 1,000 hours. and your employer may not even offer that if they don't have 50 or more employees. Basically your in a no win situation.

There is such a thing call FMLA you need to ask you Doctor to fill one out for you then they cant take your job
