I am going thru a custody battle with my exboyfriend we have two kids together I had custody of the kids up until last year when my son was accidently burned..he made it out to be abuse Children Services investigated and found no abuse..but he still has custody..the case has been dragged out for a year and half now. He called me the other day to tell me that I could not get my kids (we have a court appointed agreement) said the kids were abused by my now boyfriend..C.S. called me today to tell me that he contacted them yesterday...well he has been screaming abuse since last friday what took so long to contact C.S.? I feel I am getting the bad deal...I have a court appointed attorney...told her what was going on...haven't heard from her since yesterday. He won't let the kids call me what can I do??? I love my children and so does my fiancee' but my ex doesn't like my new boyfriend and is using all his lies againist us and it is working...well I sit back in disbelief..he has a record no

First of all, like a few people have said, get another lawyer. No matter what it takes, pawn off anything of value if you have to, these are your children your talking about. Secondly, if there is no order for temporary custody, file one immediately. If there is an order for temporary custody file an order for temporary visitation rights. Put it in paper. He is not allowed to deny you visitation unless the court has ordered that you cannot see them. At the very least he has to allow supervised visitation. If you already have an order saying when you are supposed to get visitation of the children, file to hold him in contempt of court. As for the false claims of abuse, if you can get this case moving with a good attorney, request an attorney for the children (in my state Guardian at litem) and fight fight fight. Be willing to do anything they ask, take classes, jump through any hoops, etc. If your ex has managed to get custody temporarily it will be a hard fight, but it's worth it.

Unless there is a court order standing for no visitation from you he cannot withhold visitation. In fact if there is no order standing and you still have custody over them you can take them and there's really nothing he can do except try to take them back. I would try to get a better lawyer than a court appointed one though. Good Luck and God Bless, I hope you get your kids back.

You need to fight back for your kids, the court sees you giving up and that could ruin your chances.

But I would set up another hearing and report that to the judge that he hasn't been letting you see the kids. But keep working on getting your children back.

If you have a court order stating that you can visit your kids then he has no right to stop you. You can file a motion on your own if he keeps it up.

the legal guardian can do that
you need to fight harder if you want your kids back

he shouldnt be able to do that to u!!!!!but some guys are lieing bastards.my dad keeps me from my mom cuz my mom does drugs but thats a reason...........get ur kids!!!!i dont kno how but do it!!!!!!!PRAY!!!
