Me and my husband just got married under the assumption that his divorce was final and the divorce papers were being mailed to us, well we just found out the judge has not signed the divoce papers so what do we do now?

You will have to validate your marriage and let the judge sign the papers and then you can remarry if you still want to be married. If you don't want to be married to this person then be on your way and find someone that you want to marry. I wouldn't call it polygamy because either of you knew what the judge had ommitted and it wasn't your intention to marry someone that is still married to someone else. I don't know if still would have the waiting peroid that is required by law in states but the time limit to reamarry is different. I don't know because it was the judges fault if that time limit would be validated for you, since it wasn't your error.

Get those divorce papers signed and then go back to the court house and get married again. Technically, your marriage is void.

Your marraige isn't valid. Once the divorce has been finalized then you'll have to get married again which will mean having to pay all of the fees again.

I don't know but I put the chance of you and your new husband getting a divorce at 75%.
