can he be protected by the family medical leave to not get fired on a non-work related injury ?

or can he get fired under wisconsins "at will" law

Don't think he's protected.

Who is covered?

Employees are covered if they have worked for the same employer for more than 52 consecutive weeks and for at least 1,000 hours in the proceeding 52-week period.

Three days, that's tough. I think it depends on if this information could have and should have been disclosed at the interviewing time. If it could have been and wasn't, you are still considered a "temp" and can fire you, depending on your company policy. Generally, there is a 90 period until you are full-hire.

i live in wisconsin, i believe if you are hired by a company and not on any probationary period, you are given the right to take a family leave

Generally in order to utilize FMLA a person must be with a co. for one year. Different companied have different rules, but that is the standard.

if it is a probationary period, I believe that you don't have to hold his job for him. What position is this? Entry level you will have more leway, and it would be easier to replace him. Also, if bound by family medical leave act, check into the law. It doens't mean pay for no work...find a crappy job that he can do while on it...he just may quit
