I was molested as a child and at the time, I lied about the incidences when it happend. I covered up a lot of what really happned because I was so ashamed of what really happened. Anyway, the guy got off and I want to re open the case after reading all the depositions. This time I was to charge him with what he really did so I can move on. I live in a different state now. Where do I begin?

Terrible things. Anyway, the guy got off (was nto charged) and I want to re open the case after reading all the depositions. This time I want to charge him with what he really did so I can move on and he can pay for what he did to me and GOd only knows who else. I live in a different state now. Where do I begin?

I don't think you say say someone did not do something then when they are done serving the time, come back and say I lied they relly did.

You can try but u will most likely lose the case now if the guy get a good lawyer. The problem is that u lied under oath before, & having admitted that u lied, it means that u can lie again. Meaning that your testimony will be deemed as very flawed. As I said, any good lawyer would wipe the floor with u, & u would end up feeling worse than ever. Especially when the accusations start 2 fly as 2 the 'real' reason u reopened the case. Believe me, things will get dirty in the courtroom & u will be on the receiving end of it mostly as u will be the one having 2 prove your case & the preponderence of evidence will be much heavier on u, as u lied under oath before. The guy could end up looking like an innocent martyr & u as spiteful & moneyseeking.
I feel that u should let sleeping dogs lie, for u can wind up feeling very low & depressed if the guy wins again.
Still, u can try once the statutes of limitations haven't run out, but be prepared emotionally if u lost again.

How old are you and how long ago was it? Most likely the statute of limitations are far expired and criminally you can no nothing....however, you can still sue in a civil court...but if the man isnt wealthy, you cant get blood from a stone.

You should review the law on "double jeopardy." If this person was already tried for the crime and was aquitted, he cannot be retried for the same crime.

Talk to the district attorney in your area. They prosecute crimes on behalf of the people.

you have to forgive him and move on . its too late you made a police report and in law you agreed in your statement. if they find you were lying . you would be charged for falselfying a statement . it is called purgury. forget it and move on . I wish you well and try to put your past behind you and try and be kind to yourself and make a new life for yourself
