Harry is under the invisibility cloak on the tower with Dumbledore and Snape. However, before their confrontation Dubledore puts a freezing spell on Harry so he can't move or talk. He knows Dubledore is dead when he's able to move again.

He was under a curse that immobilized him. I forget what it's called, but Dumbledore put it on him to protect him, I think he was wearing his cloak. He tried to do a silent spell but couldn't do it. When Dumbledore died, the spell lifted. They were outside in front of the school, I think.
