She has been married for four months and her husband just decided that he wants a divorce. He told her she needed to leave and wouldn't even let her back in when she came back to get her son's belongings for the night. What are her rights in the state of Indiana? How should she proceed from here? Should she consider hiring a lawyer? They don't have kids together. He is leaving her with nothing. She is a stay-at-home mom. All of this has come as a shock to her because they had not been arguing and he won't give her a reason why he wants the divorce. Please help by answering my question.

If there is a divorce pending, she definitely needs a lawyer. She should also look into any bank accounts that she and her husband hold together. He may have already frozen her out. If he hasn't, she should close any joint accounts and get one in her name.
She will need legal guidance and help getting a legal order to go into the house for her and her son's belongings. She should not try going on her own. He will need to come up with a reason for the divorce if he wants one. Divorce decrees are not granted just because someone wants one.

Your friend might as well get a job, and hire a lawyer. As to the child's and her belongings, she may have to call the police to intercede while she collects them. It is customary that a woman owns her clothing and jewelry. Indiana is NOT a community property state, so she isn't necessarily entitled to any furnishings in the home. She will have to prove she owned an item before her marriage.

Any woman today who doesn't have her own separate bank account is a fool. You cannot be certain of anyone's reliance. You cannot be certain something (death, or accident) will not occur, and leave you cut off from your monetary resource.

My husband's cousin, after more than 15 years, kicked his wife and children out of their home. He is an alcoholic, but was also handicapped by a work injury. Texas is a community property state, so during the divorce he managed to get half of her retirement savings.

Her husbands actions are illegal. She owns half that house. She should get a lawyer right away.

He can not do that!!!
Please tell her to look into it and call the police any police officer should be able to explain the laws and I do believe that one of them is HE CAN NOT DO THAT!
