I want to force a company to give me all records of the recorded calls from when I have phoned them - if they exist.

How can I do this? I was thinking of usign the Data Protection Act 1998 Subject Access Request - would this work?

DO I have to give times and dates of when I called them or can I just ask for all recordings they have of me?

I already have a small claims case with them and these calls will be part of my evidence! So I dont want another case just to get those calls.

I thought it was a part of the data protection act? You dont need a court to enforce that for you...

You need to file a suit against them and have a judge order it. He will if he feels it is vital to the case.

Filing small claims is easy, just go to the courthouse and speak to the info desk, they will direct you.

If this is for a criminal case, then you need to speak to a prosecutor today.

You're going to have to come up with dates and times. Most companies can't search for your calls based on your phone number or name.

There may be information in your file that documents when you called, but if you're trying to nail them for something, they have very little incentive to do your research for you.

You should be assured that if they say the call "may be recorded," it probably is. They need to cover their butts, too.

Good luck doing this. They have to turn them over to you. But good luck proving when the calls were recorded, since all they tell you is that they "may" be recorded.
