I and $214 in the hole with my propane company.. Can they legally cap my tank in the winter time? I live in NY and the weather is extreamly cold right now and if they cap it my heat will go out and pipes will freeze! Is there any health laws or anything like that protecting my rights? And yes I do plan on paying them.

Legally, if you pay them something, like $10 they have to keep it turned on. Whenever you owe money to someone, pay something, and by law their not suppose to take action. If I were you I'd give them something and beg and cry really hard. I'm not jokeing, I've done it and I might do it again.

Yes they can. It is the same thing if you don't pay your electric bill or phone bill, they turn it off. The only way to turn off a propane tank is to cap it. I'm sure they have sent you plenty of warning notes with your unpaid bills. They probably put notes in the bills to contact them to work out a payment arrangement. If you just ignored the bills they didn't have any other choice put to cap your tank. People do have trouble paying their utilities all the time and the utility companies do their best to help you out when times are hard so you don't get your service turned off like you have. Maybe you should call the company and work out a payment plan so they may be inclined to turn your service back on. If they company doesn't know your situation, how do you expect them to help you when you need help.

If you don't pay they can turn you off - your best bet is to get on the phone right now with the company and try to work things out.
They are not required by law to furnish you with free propane. Most companies though will work with you - but you have to be persistent and honest with them.

If you plan I paying them there should'n be a problem. Call and tell them what your plans are. They can cap it for none payment but I think if you call them they won't. Because the temps. are so low it could cause you to freeze to death. I still would not chance it. Call and give them 10 bucks if you can it is called good faith money.

I suppose if you are asking they already have. You should call them and ask if you could pay them in small installments. At least that way they know you are at least trying to pay them and not blowing them off.

The tank is their property. They are not required to provide you a service. It's no different than cable.

Yes they can and they obviously did. If you plan on paying them, I recommend you do so. Or get some space heaters.
