A friend of mine her son's friend overdosed and died in her home. The boy was 18 but she is worried the parent's will sue her. Is this possible? Please help.

It is possible if as the son was left in their care; get a lawyer as soon as possible before answering any more questions than have already been asked.

You can be sued at most any time for most any reason. Whether or not a case is successful depends on the total picture. This would be a civil action, such as a wrongful death suit. So the short answer is yes, she could possibly be sued. The criminal side would depend on the investigation of the death and the coroner's report. If the investigators believe that the person died of an overdose and there is no evidence to point in any other direction they will relay their opinion to the medical examiner and prosecutor's office and the case will be closed.

no, they cannot possibly sue her on the grounds that she did not supervise AN ADULT ( he was 18, yes?). they can however sue her if she gave him (not that he found it in a cabinet) whatever it was he overdosed on. impossible to prove. get a lawyer immediately to thwart the case at filing. if a lawyer already represents you, the case has a better chance of not being entered as a case from the get go. how terrible for everyone involved. good luck to your friend and her son. god bless

the issue will be if the person knew that the boy was doing durgs and was in distressed. second did they act (call 911) if not why not? third were the drugs ingested in the home or outside the home? fourth, did anybody else inthe home also take the drug or help obtain the drugs?. cases such as these fall into the same catagory as someone buying beer or alcahol fot a minor and they have an accident or die (bartenders included) the party who allowed the act to happen is as culpable and liable.

Yes she can be sued. Was she at the house when it happened? Anyways, I know that when a parent is home and there is an underage drinking party or drug party at their house. The parents become legally responsible. Tell her to get a lawyer quick. Good luck. Fight it and hopefully everything will be fine. My friends parents did not get much of anything.

Yup. She can be sued. It depends on what she let happen in her home, that led up to his death and how much she knew.
