It will usually tell you on the labeling on the plant. This might be on a sticker on the pot, on the stick stuck in it. If it is a bagged plant, like a bulp it will say on there. A good clue is the plants name. There is the type of plant and then the name they have given it. it sometimes has a copyright symbol around the given name. Hope this helps. Roses and Fruit trees are notorious for being patented. Trademarks are usually companies like Jackson & Perkins, Sunset, Burpee..just to name a few.

On Roses there is usually a metal tag wrapped with wire loosely on the bottom most branch of the rose. Be it a bushy, tree, miniature or potted. These come also wrapped in paper in plastic bags, you can buy the second runs for about $5 at any hardware store or plant store/nursery. For more on roses go here www.jacksonandperkins.com

Fruit trees they have little plastic labels on them, usually they come in a 25 gallon tubs and run in price from $200 up. (First run trees with established root systems)

Bulb flowers, Lilacs, Gardenias and other plants are also available as a patented plant. You will pay more for them, because they are first run plants

Patented names are very popular, you can do a search for plants on google to get more information.
