Hicks will be first up in court in 12 days time.This is going to be a ripper of a legal battle.The High court of Australia has ruled that
the Australian Government has a case to answer over the handling of Hicks and it is on.The separation of powers of the judiciary and the executive is quite different here in Australia than it is in the States.

mIaI it is called the Australian constitution and the problem is not yours.The Howard government stated that Hicks had not broken Australian law when in fact only the Australian high court can decide that.He is ours and should face the law here.

Well I hope not but who the hell knows whats going to happen next with him. Did you see his lawyer talking on 60 minutes the other night? He said that Hicks could have been brought home easily with one phone call from Howard. He said that it wasnt about justice or the law is was all about politics. But Howard has left it so long to do anything about it, people were saying that he probably wanted Hicks to get charged from America so that he wouldnt look bad.

Also did anyone else find it strange that after all this time Hicks was charged very soon after Dick Chainy left Australia?

Technically, Australia has no right do demand Hicks be released. In fact under the Laws and Customs of War, Hicks is classified as a mercenary and as such is explicitly excluded from any and all protections granted by the Geneva and Hague accords.

What I cannot figure out is why this guy gets any sympathy.
