well my boyfriend worked for a family run frachise of a larger company, an ice cream shop.

the owner of the particular location has been gone for some time, out on surgery.

he has left the running of the shop to the rest of the high school age employees.

my boyfriend has been after the w-2 since jan 30 at first he was told the w-2 were AT the assistant managers HOME. she did not respond or return phone calls. now she has brought them back to the job and his is not there.....she doesnt know what happened.

what is the next step?
call the irs?
call the main company directly?
isnt this illegal?
what kind of threats of legal action can he take?

we tried to use the last paycheck stub but his last 3 paychecks were written in personal checks by the owner!!!! we cant accurately calculate his total income or amounts withheld!

It is illegal for a company to not submit the paperwork for him to receive his w-2. They can be fined for this. Report it to the IRS.

If you don't receive your Form W-2 (PDF) by February 15, contact the IRS for assistance at (800) 829-1040. Also, you may want to refer to Tax Topic 154, Form W-2 - What To Do if Not Received, to see the specific information the IRS will need in order to prepare a Form 4598, Form W-2, 1098 or 1099 Nor Received, Incorrect, or Lost. You will be sent a copy of Form 4598 along with a Form 4852, Substitute for Form W-2, Wage and Tax Statement, or Form 1099R, Distributions from Pensions, Annuities, Retirement or Profit Sharing Plans, IRAs, Insurance Contract, etc.

If you have repeatedly tried to obtain you W2 and the company has not provided it, you may file your taxes with a Substitute W2. This means you will have to paper file, as they can't be electronically filed.

I suggest you to to a tax preparation company, explain the situation, and ask the tax preparer to assist you with a substitute W2. You will need to bring your last paycheck showing year to date information such as gross wages and withholding, so they can prepare the tax information from that.

The IRS will then contact the employer and ask them for a W2. If it turns out that the W2 is not the same as yours, then you may need to amend your return.

Serve a demand letter requesting for your W-2. If this was not given due course, you can file a case in court so that the employer will be ordered to give you the W-2.
