Almost 2 years ago I moved out of our house and continued to pay the mortgage off. This year the divorce was financially settled and I paid a lump sum and we came to the agreement that she is to sell the house. Until it is sold I am to bear all costs for the house i.e. means gas, electricity and of course the mortgage. I find this very hard because I had even to go into debts to pay the lump sum. I gave also a part of my pension away. All along the settlement I was advised by an solicitor. But yet I feel that it was onesided. What can I do, am I entitled to pay just the interest and not any more the principle of the mortgage and may I stop paying for gas and electricity?

Are you getting anything out of the proceeds of the house sale? If not, I don't understand your settlement at all. First of all, there should have been specific timelines and actions that had to be taken. For example - it should state that the house is to go on the market within 30 days for X amount of money. If an offer is recieved that is within 10% of X then the offer must be accepted. If the house is not sold within X weeks the price is to be lowered to X. The house should not be sold for lower than Y unless both parties agree in writing.

All this should be spelled out in your divorce judgment. That way, if she doesn't comply with one of the steps - you go back to court for her contempt of court and have a judge deal with it. You need to speak to your lawyer and find out what are the mechanisms he had in mind in order to enforce this judgment.

If it was agreed upon in court, she must sell the house. If your name is still on the mortgage, you can put it up for sale, i think, without her. Call a lawyer if need be, cuz she is not holding up her end of the divorce decree. you could always torch the house when you know shes not home and collect the insurance money, then she has no choice but to get the hell out. (just kidding about torching the house b.t.w)

You must follow the stipulations in your divorce decree. If the courts said that you should sell the house the it should be sold. If the ex can get up the sale price she can buy it out right but other wise it gets sold and there is not deciding not to sell. Take her to court and have the rulings enforced.

Did the courts put a time period on selling the house and if not you will have to pay until she is ready to sale.Sounds like she is playing games.The only thing you can do is try to buy her out or get her back in court.She isn't a Honourable woman is she.Can you get her for braking the agreement?

Don't pay anything and go back to court you should not be paying for their use of gas and electric refuse to pay if she wants it let her pay she is getting off with this lightly, DON'T pay another thing till it is sorted out. Good luck

I agree with the last person - it's time to consult your lawyer. Any thing could be cheaper than paying months of mortgage. She might owe you now.

man o man go back to your lawyer or get a new one. this has to stop . look at all the money your paying out. she has to go by what the court tells her and you.
