ok my little brother headbuted a teacher and he is 9, can he be charged with assualt and is assualt a felony in the state of south caroiliona?

He could be charged in juvenile court if the school insists, but at the age of 9, the school would be foolish to do so. These type of things should be handled between the parents and the school. Your parents need to discuss the matter with the school authorities.

Doubtful. First of all, most states do not hold kids that age accountable as adults unless the crime is especially heinous and the facts indicate that the kid understood the consequences of his actions. I doubt if a head butt from a nine year old qualifies. Even in South Carolina.

Now I suppose they COULD refer the matter to juvenile court where he could possibly be convicted as a juvenile, the record sealed and some penalty imposed. Most schools do not go that far and resolve it with administrative action such as suspension or expulsion. Since you dont really say much about why this happened or if it's a continuing problem, it's hard to really tell.

I wouldnt worry about a felony. However, I think your brother may have some behavioral problems that should be addressed.

He's young and a judge would probably laugh them out of court. He could be, but he'd probably just get diciplined by the school. I doubt there is anything to truly worry about.

Given his age I doubt it would happen but yes he can. If he would be charged it would probably be a misdemeanor.
