Only if it has any residue from being used to smoke something illegal. If it is clean, it is legal. It would be impossible to prove you possess it for any illegal activity. Bongs can be used just as easily for smoking tobacco than marijuana. In fact, most places that sell bongs hate that word, "bong." They prefer to use tobacco water pipe.

no, they are sold with the intent of tobacco use. and tobacco use is legal in all 50 states. for it to be considered drug paraphernalia, it must contain drug residue within the bong.
